1. Service Description

FairCheck.ai provides algorithmic bias detection and analysis services. We analyze data you provide to identify potential demographic bias in AI systems and decision-making processes.

2. No Legal Advice

CRITICAL: FairCheck.ai provides analytical tools for informational purposes only. Our reports:

• Are NOT legal advice
• Do NOT constitute certification of compliance with any law or regulation
• Do NOT guarantee your AI system is free from bias or discrimination
• Should be reviewed by qualified legal counsel before making business decisions

You must consult with your own legal counsel regarding compliance with applicable laws including EEOC, ECOA, Title VII, Fair Housing Act, and other regulations.

3. User Responsibilities

You agree to:

• Provide accurate information and data for analysis
• Anonymize or remove personally identifiable information (PII) before uploading data
• Use our services in compliance with all applicable laws
• Not use our services for any unlawful or fraudulent purpose
• Maintain the confidentiality of any account credentials

4. Data Ownership & License

Your Data: You retain all ownership rights to data you upload. By uploading data, you grant us a limited license to:

• Process and analyze your data to provide the requested services
• Store your data temporarily during analysis (typically deleted within 30 days)
• Use anonymized, aggregated data to improve our services

Our Analysis: Analysis reports and results we generate belong to you. We may reference anonymized findings in marketing materials or case studies.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• FairCheck.ai is provided "AS IS" without warranties of any kind
• We are not liable for any damages arising from your use of our services
• We are not liable for any legal claims, fines, or regulatory actions related to your AI systems
• Our total liability to you shall not exceed the amount you paid for services (or $100 if services were free)

6. Indemnification

You agree to indemnify and hold harmless FairCheck.ai from any claims, damages, or expenses arising from:

• Your use of our services
• Your violation of these terms
• Your violation of any laws or third-party rights
• The data you provide to us

7. Service Modifications

We reserve the right to:

• Modify or discontinue services at any time
• Update these terms with notice
• Refuse service to anyone for any reason
• Change pricing for future services

8. Free Analysis Terms

Free bias analyses are offered on a limited basis and:

• Are subject to availability
• May be limited in scope compared to paid services
• Do not create an ongoing service relationship
• May be used by us as anonymized case studies

9. Intellectual Property

All content, algorithms, methodologies, and software used by FairCheck.ai are our proprietary property. You may not:

• Reverse engineer our analysis methods
• Copy, reproduce, or distribute our tools or reports (except for your internal business use)
• Use our name or branding without written permission

10. Termination

Either party may terminate services at any time. Upon termination:

• We will delete your data within 30 days (unless legally required to retain)
• You will lose access to any account or stored results
• Provisions regarding liability and indemnification survive termination

11. Dispute Resolution

These terms are governed by the laws of Illinois. Any disputes will be resolved through:

• Good faith negotiation first
• Binding arbitration if negotiation fails (except for equitable relief)
• Jurisdiction in Will County, Illinois

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FairCheck.ai.
